i have a podcast: dj creator in the mix and i use music from filestube.com.
i use also music from jamendo.com.
am i on the illegal way?

Correct; you do not have a license for rebroadcast. Don't sweat it.

buying the music is a little different form getting permission to play it on your podcast or obtaining royalties. As far as im aware, yes it is illegal to play music that is either not your own or you have permission for. There are some places where people have podcast friendly music they have written themselves that you can use in your podcast, try searching for something like that. I think there is also a rule that if you do play any commercial music, you need to only play 30 secs worth of if. Then it's leagal, any more than that and your not tho.

Agreed. When you put music it's for personal use only. Technically, it's even illegal to make a mix tape and give it to friends, but the record companies don't really sweat that. The problem you could face is if the record companies or the RIAA gets wind of your show it can legally force you to pull the podcasts with their stuff in it, and a lot of hard work does down the drain, or you'll have to re-record the shows which is just added work. I do my post production in Audacity and keep the files so they can be re-edited later if necessary.
And if they REALLY wanted to stick it to you, you could get a sizable fine in civil court.
As for the so-called "30 second rule" The Fair Use laws are pretty vague and don't specify how much time is allowable. Technically, NO time is allowed for copyrighted material use without permission.

In my personal opinion, I don't think they will come after you if you use short bits of music, but entire songs and long sections of songs can get you in trouble. It's a big Internet, and of course they might not FIND you, but since we're all looking for large audiences it becomes a matter of you making it easier for them to take notice of you.
I prefer to keep safe whenever possible. My theme is done by Dave Latchaw who offers it as royalty free (podcast safe), free music with few strings attached.
