So, uh, you're talking about the name, right? Are you sure they didn't start their show first?

I don't see a direct link to the show with the same name as yours, so is there anything to worry about?

Have you trademarked your name (you can't register a copyright for an entire series, so that's why you should trademark your name)?

Until those questions are answered, it's not so fair to imply they stole your entire podcast. Honestly, no offense to you, but The Pyschotic Hour doesn't seem like a tough name to come up with, especially given the counter-cultureral nature of Podcasting. It's highly possible that two folks had the same cool idea for a name.

I did notice a site announce they were going to start the "new Rubber Room" podcast in April, but it never got started. I began podcasting in January, so I knew my show was first. I sent them a comment about this and never heard back from them.

i actually think the other podcast claims to be the "home" of whatever the podcast is, and plays the guy's podcast in theirs. i believe thats what happens

That could be, bu until someone actually listens to it to confirm that, then its not really accurate to say they have anything but the same name...
