What are your thoughts over using music for background/ambient music for podcasts?

I record my podcast while driving. It's a sort of "ride along with me while I drive" sort of thing. As such, I usually have a CD on in the background. I'll reference the song or mention if it's an indie artist. But I don't play songs through, and certainly not in full audio quality. It was my understanding that gaps in the music or talking over is cool, provided you're not "distributing" the song in a format in competition with the content owner's format.

My intro music is cool, because they release under Creative Commons. And since this isn't a "music show", do you think I'm treading dangeous waters?

Point me at any other threads if this has been brought up before.

Firehouse radio does talk over for a couple of their segments if I remember correctly.

I think it sounds great. So great that I have started to download garageband music in prep for my first episode of the josh in japan podcast. 8)

I still don't fully understand what's legal and what isn't. So, even though I only use about 20 second in between interviews, I still only use garageband or other bands that I have some connection with.

What did I read here recently about Apple covering podcasters for short clips?
