Let's get ready to legally rummmmmmmmmble! In the red corner, we have Shae "Shady!" Spencer Management, and in the blue corner "Too" Boku "SoulBrotha" Curry!
Let's get it on!
I'm having to much fun with that name.

I don't think it's too late at all. I mean, do you "photocopy" or "xerox" stuff? The first word something it branded with isn't always what sticks.
Frankly, I'm sick and tired of living in this podGeneration or this iWorld. The products are great. But they sure aren't worthy of branding the globe with their ridiculous prefixes.
All we have to do is STOP using the term. I agree some people fear change though.

The strnge thing is I searched all over for some information about the two companies listed and nothing came up. No websites etc. Perhaps they are fronts for Adam Curry.

I hope there is a push to rename the whole thing. I feel silly everytime I tell somebody my new hobby.

Oh HELL yes!
How about everyone, just until the end of April replace all instances of "podcast" with "timmy"?
But nobody reference it in the show. Just do it?
I'm up for it!
The NGR Bugcast. The unofficial timmy of the nocturnal commuter. :P

This was discussed ad nauseum at the Yahoo podcasters group a few weeks ago:
http://groups.yahoo.com/group/podcasters
The trademark application was filed the day after the USA today article on podcasting came out. That should tell you something.

No the APCT* has now trademarked 'Timmy' and can't use it. This is in revenge of childhood attacks on our sacred name. :D
Only good friends can call our members Timmy, or Timbo, otherwise they get the Evil Destroyer Stare of Death (tm).

Currently one member, but I welcome membership from other podcasters....called Timmy, err Tim. Ahem.

P.S.
How can they trademark something that has prior usage? I mean in print and other places podcasts and podcasting has been widely used before the trademark? I mean even this very site uses the term...before the application. And all the blogs etc...
I agree it's a silly term, I wish there was something more platform neutral because I heard the reference mid last year but ignored it as I didn't have an iPod...I bet a lot of people have the same reaction to the name.
And I suppose this trademark is why AC has used the term podshows...?

Yeah. Though I wish he'd have kept the "cast" and changed the "pod"to something else.
Why is everyone so hung up on that word anyway.

They can't. This is an application only and will be summarily rejected upon review. It's nothing more than a shot in the dark by the applicants.

Agreed
And I suppose this trademark is why AC has used the term podshows...?
Highly unlikely...more likely that he just wanted unique branding.

Hi,
First, On topic! They can't trademark prior use, as already noted above!
Now Off Topic: I've been listening to Podcasts since sometime in early December, when I read an article somewhere online (don't remember where, exactly). I've been kind of skimming the boards here the last few weeks to get a sense of the "community," which is pretty much about what I expect from any online community: There's the usual troublemakers, the evangalists, etc. But strangely, to me at any rate, there's also this seemingly vehement resentment to... well, I guess you could call it a phrase.
As someone who listens, and has nothing vested in Podcasting (aside from listening), let me help educate you on at least some of your new listeners, and where they're coming from (both figuratively and literally):
First, "the literally": The recent spate of newspaper and media articles that cover Podcasting are drawing a large amount of new listeners to the genre. Anyone who reads through the first paragraph in 98% of these articles will know that "Podcasting" is not just for iPods, because they very clearly state it.
Secondly, "the figuratively": What attracted me to check out "Podcasting" was the name. Not because it is associated with Apple computer, but because it is new, unique, and even vaguely exotic. The net is full of streaming radios, blogs, P2P networks, etc. "Podcasts" are a new phenomonon, and are identifiable as such, in part, because of their name. If Podcasts had been called Netcasts (for example), there's a chance I might not have tried them out unitl much later, because the name isn't really that identifiable as being something unique.
I know folks in the Open Source community, and they swear by it. That's cool. Given Podcasting's ties to the open source community, I can even understand some of the distaste in the mouths of you who dislike the name. But the flawed logic here (gathered from some previous posts), is that Apple (a big corporation) is somehow gaining undue publicity and exposure because of Podcasting. That's only partly true. By comparison, Podcasting is gaining much more atention from the name association than Apple is. After all, iPods were already insanely popular when Podcasting began. It's a win-win situation for Podcasting, and Apple. And why should you really complain about that? There's no real reason to become an apologist over a name!
Just something to think about before you name all your shows Timmy.
Peace!
Eric

Agreed also, despite the fact that it seemingly contradicts my previous agreement. (Good grief, I'm starting to sound like a politician.)
